Terms and conditions of booking Hyrczyk Apartments

I. General provisions

 

These Regulations define the conditions under which you can make a reservation and rent accommodation in the chosen Apartment. Making a reservation is tantamount to accepting the Terms and Conditions. The agreement between the Client and the Client is concluded at the moment of booking on-line, via e-mail or by phone.

II. Booking

1. In order to make a booking, the Client reserves a stay in the chosen period. A confirmation of the preliminary booking of the Apartment shall be sent to the Client's e-mail address. Should the confirmation of payment of the total deposit as specified in the booking confirmation be lacking, the Lessor shall retain the right to cancel the booking.

 

2. The booking confirmation sent by the Lessor includes:

 

a) date of Client's stay

 

b) amount due for rent

 

c) information on the amount of the deposit

 

d) bank account details

 

e) general terms and conditions of booking

 

3. Upon receipt of payment for the booking, the Client will receive an e-mail confirming the payment and a code for the main entrance to the staircase and a one-time code for the first entrance to the apartment, where a reusable access card to the apartment and the power switch system will be waiting. Deposit - as defined is non-refundable under Article 394 of the Civil Code.

 

4. Should the amount of the deposit paid not cover the entire amount of the booking, the Client is obliged to pay the remaining amount within the period specified in the booking confirmation.

 

III. Terms and conditions of the rental agreement

 

1. The rent of the apartment includes all charges for utilities, disposable items included in the equipment (cleaning products, cosmetics) and services available to Guests of the facility.

 

2. Stay:

- begins at 3:00 p.m. on the day of arrival and ends at 10:00 a.m. on the day of departure

a) The earlier availability of the apartment on the day of arrival depends on the current occupancy of the facility and is each time considered individually by the Lessor. Regardless of the Lessor's goodwill, the Lessor does not guarantee early check-in on the day of arrival in advance. In order to obtain the guarantee from the Lessor, it is necessary to pay an individually determined amount for early rental of the apartment.

b) The prolongation of the stay depends on the current occupancy of the facility and each time is considered individually by the Lessor. Irrespective of the goodwill of the intermediary, the intermediary does not guarantee an extension of the stay on the day of departure in advance. In order to obtain a guarantee from the intermediary, an individually determined amount must be paid for a later check-out.

 

c)  Hyrczyk Apartments provide services according to their category and standard. In case of any reservations concerning the quality of services, the guest is asked to report it immediately at the reception desk.

 

3. The Client shall be obliged to immediately notify the Lessor of any events that may put the owner of the premises at risk of material damage or endanger the safety of other Guests staying on the premises

4. The Client may only use the apartment for residential purposes and may not sublet it.

5. By booking the apartment, the Client agrees to pay a service charge in the amount specified in the booking confirmation.

6. Children under three years sleeping on a bed with adults or in their own bed and not requiring bed linen do not pay any fees for the stay. Other children are charged according to the booking conditions.

7. As part of the reservation, the Client is entitled to a free parking space near the building in a specially designated and marked place. The parking space is unguarded. The Manager is not responsible for damage or loss of a vehicle or other vehicle belonging to the Guest left in front of the building or on the unguarded parking lot.

8. Check-in after 9:00 pm and check-out before 7:00 am which requires presence of the Manager must be notified and arranged in advance. Manager's arrival/departure between 9:00 p.m. and 7:00 a.m. is subject to additional fee of 100 PLN.

IV. Client's responsibilities

 

1. The actual number of persons to stay in the apartment is limited to that specified in the booking confirmation. The client is obliged to inform the Lessor of any change in the number of persons staying in the rented apartment.  Should the Apartment be used contrary to the booking conditions, the Lessor may refuse to check in and block the codes and cards of the booked Apartment. In such a case, the Client shall be obliged to cover the full amount of the booking.

2. The Client shall be obliged to inform the Lessor of the additional person to be accommodated before such a situation occurs. The Lessor reserves the right to refuse to accommodate additional persons if the total number of such persons exceeds the technical capacity of the given apartment. The additional persons shall be invoiced as agreed upon between the Client and the Lessor.

3. The Client undertakes to observe the principles of good neighbourhood. The facility's quiet hours are from 10:00 p.m. to 6:00 a.m. Failure to observe the quiet hours will result in the obligation to leave the facility immediately without any refund.

4. The Client and their Guests are responsible for any damage caused in the rented apartment, public areas and on the premises of the facility and shall immediately notify the Lessor of any damage and undertake to cover it.

5. The Client and their Guests are responsible for all clothing, personal items and money brought with them. Clothing and personal items left behind by the departing Guest may be returned at the Guest's expense to the address specified by the Guest.

6. Smoking is prohibited throughout the premises of the facility.

7. It is prohibited to walk in ski boots in the facility. Skis and ski boots must be left in an appropriate place for them.

8. The Client is obliged to return all the access cards received for the duration of the stay in the apartments. Failure to return all the cards will result in a charge of 50 PLN by the Lessor for each card not returned.

9. The Guest is obliged to present to the Lessor a document with a photograph confirming the identity of the Guest. If the Guest refuses to produce the document at the request of the Lessor, the Lessor is entitled to block the codes and access cards to the apartment and the facility.

10. The Lessor and their Guests can only use the parking spaces that are specially prepared for the Guests renting Hyrczyk Apartments in the vicinity of the facility. Parking in front of the grocery store for longer than 15 minutes is strictly forbidden under pain of towing at the expense of the car owner.

 

VI. Changes in the booking

 

1. Modification of the booking after it has been made is possible only by individual agreement with the Lessor. Confirmation of the booking modification shall be made by e-mail.

 

VII. Transfer of Client's rights and obligations to another person

 

The Client may transfer all the rights to which they are entitled under the booking to another person, if that person accepts all the obligations resulting from the booking. In such a situation the Lessor shall be immediately notified of the change of the Booking Person, specifying the personal data of the person who takes over the rights and obligations resulting from the agreement. The person taking over the booking shall be obliged to confirm it by e-mail, modifying the booking with the necessary personal and payment data.

 

 

 

VIII. Force Majeure

1. The parties may evade liability for non-performance or improper performance of the concluded agreement if it occurred as a result of a force majeure event.

2. For the purposes of the agreement, "force majeure" shall mean any event preventing the performance of an obligation, beyond the control of the parties, which the parties could not foresee at the time of concluding the agreement and which could not have been prevented, including but not limited to: acts of nature, state of emergency, state of war, new legislation or administrative decisions, technical failures affecting the performance of this agreement and/or any other events of a similar nature. Should the occurrence of such events prevent either party from properly performing the agreement, the party seeking a waiver of liability, pursuant to para. 1 above, must immediately notify the other party in writing of the occurrence of a force majeure event justifying such a waiver.

 

IX. Applicable law

 

The law applicable to the disputes between the owner and the Client is the Polish law. Disputes shall be settled by the Court appropriate for the registered office of HYRCZYK MARKET ANDRZEJ HYRCZYK.

X. Processing and protection of personal data

 

We would like to inform that data obtained from the bookings made will be processed by Hyrczyk Apartments as the administrator in the scope necessary for registration purposes, fulfillment of legal obligations (including tax obligations) and in order to protect our own justified interests in the form of enforcement of potential claims for property and non-property damages and defense against possible claims of other persons.

 

We inform you that in relation to the above data you have the right to access, rectify, delete or restrict processing, the right to object to processing, as well as the right to move the data. Please be informed that providing the above data is necessary for the fulfilment of booking purposes. In the case of failure to provide such data, it will not be possible to perform the registration purposes. Please be informed that in connection with the processing of personal data you have the right to lodge a complaint to the President of the Office for Personal Data Protection (2 Stawki Street, 00-193 Warsaw).

 

 

Complaints

 

Complaints as well as other disputable issues should be addressed to the e-mail address apartamentyhyrczyk@onet.pl. In accordance with Article 7a of the Act of 30.05.2014 on consumer rights, HYRCZYK MARKET ANDRZEJ HYRCZYK is obliged to respond to a complaint within 30 days of its receipt.
